About Land’s Edge Foundation privacy policy
This policy explains how the Land’s Edge Foundation collects and manages personal and health information in line with the Privacy and Personal Information Protection Act NSW (PPIP) and Health Privacy Principles (HPPs).
The Land’s Edge Foundation respects clients’ right to privacy and is committed to protecting information collected.
NSW privacy law and this policy must be adhered to by all Lands Edge Foundation staff, contractors and volunteers.
What we collect
The Lands Edge Foundation collects the following types of information:
- Information about students/participants and their families provided by students, their families (Parent/Guardians) and others – for example but not limited to: informed consent for activities provided, contact details, health information, name, date of birth, medical insurance address, street addresses and phone numbers.
- Information about job applicants, staff, volunteers and visitors provided by job applicants, new and existing staff members, volunteers, visitors, such as trades and services where deemed necessary and others – for example but not limited to, qualifications, working with children checks, visas and banking details, email and home addresses and contact numbers.
- Information about the activities of participants, students, teachers, staff and families if they attend a Lands Edge Foundation facility or program (for example but not limited to images captured through CCTV or photographs)
- Recording of incidents including but not limited to, narratives about the incident, medical centre or hospital visits
- Google analytics, looks to analyse how users navigate our website and help target new or emerging markets. Third party vendors, including Google, use cookies to serve ads based on a user’s prior visits to our website or other websites
How we collect information
The Lands Edge Foundation collects information in a variety of ways, including:
- in person and over the phone: from participants, students and their families, staff, teachers, volunteers, visitors, job applicants and others
- from electronic and paper documentation: such as job applications, emails, invoices, letters, and forms (such as enrolment, excursion, medical, specialist or consent forms)
- through Lands Edge Foundation websites and Lands Edge Foundation social media
- through online tools: such as apps and other software used by Land Edge Foundation or its clients
- through any CCTV cameras located at sites
- through photographs, film and other recordings
- through polls, surveys and questionnaires
- in some cases, through authorised information sharing arrangements with other services.
Primary purposes of collecting information about participants, students and their families
The Land’s Edge Foundation collects information about participants, students and their families when necessary to:
- support participants’/students’ health, social and emotional wellbeing whilst on camp
- fulfil legal requirements, including to:
- take reasonable steps to reduce the risk of reasonably foreseeable harm to students, staff and visitors (duty of care on behalf of The Land’s Edge Foundation clients)
- make reasonable adjustments for students with disabilities (anti-discrimination law duty of care on behalf of The Land’s Edge Foundation clients)
- ensure, as far as is reasonably practicable, the health and safety of participants when on camp (occupational health and safety law)
- enable Land’s Edge Foundation to:
- communicate with parent regarding their child’s health, disabilities, dietaries or well being to support them on Land’s Edge Camps
- comply with reporting requirements
- investigate incidents on camp and/or respond to any legal claims against the Land’s Edge Foundation, including any of its clients
Purpose for collecting information from staff
Land’s Edge Foundation collects information about participants, staff, volunteers and job applicants:
- to assess applicant’s suitability for employment or volunteering
- to administer employment or volunteer placement
- for insurance purposes, including public liability and WorkCover
- collect working with children checks
- to fulfil various legal obligations, including employment and contractual obligations, occupational health and safety law and to investigate incidents
- to respond to legal claims against The Land’s Edge Foundation or its clients
How we use information and/or disclose information
The Land’s Edge Foundation uses or disclose information consistent with NSW privacy law and other associated legislation, including as follows:
- for a primary purpose – as defined above
- when the Land’s Edge Foundation reasonably believes it is necessary to lessen or prevent a serious threat to:
- a person’s life, health, safety or welfare
- the public’s health, safety or welfare
- when required or authorised by law – including as a result of anti-discrimination law, occupational health and safety law, child wellbeing and safety law, family violence law, or reporting obligations to agencies such as the Department of Health, or where mandatory reporting is required
- to investigate or report suspected unlawful activity, or when reasonably necessary for a specified law enforcement purpose, including the prevention or investigation of a criminal offence or seriously improper conduct, by or on behalf of a law enforcement agency
- as de-identified information, for research for The Land’s Edge Foundation statistics purposes, or to inform Land’s Edge Foundation policy
- to establish or respond to a legal claim or incident investigation.
Storage of private information
The Edge Foundation Stores information securely in electronic and hard copy formats. Information is only accessible for the duration of its intended use (see above), storage and archive of information will be kept securely on Land’s Edge Foundation premises or electronically archived.
